These Terms of Use are a binding contract with East Texas Broadcasting that conditions your use of the East Texas Daily News Classifieds. If you choose not to be bound by these Terms of Use, do not use the East Texas Daily News Classifieds and leave this website. If you remain on this site, return to this site, or use the East Texas Daily News Classifieds in any way, you are agreeing to be bound by these Terms of Use and any subsequent revisions. East Texas Broadcasting may revise these Terms of Use at any time for any reason without notice to you, other than by posting a revised Terms of Use on this site. Your continued use of the site and/or the East Texas Daily News Classifieds constitutes acceptance of such revised Terms of Use. East Texas Broadcasting reserves the right to modify, limit or discontinue the East Texas Daily News Classifieds and this site at any time, either temporarily or permanently, including but not limited to modifying, limiting or discontinuing any features or services offered, and/or blocking or terminating your account and access to the site. If you object to any of these Terms of Use or any future revisions to these Terms of Use, your only recourse is to discontinue your use of the site and the East Texas Daily News Classifieds. Any violation of these Terms of Use may result in the immediate termination of your account and the revoking of your right to access the site or otherwise use the East Texas Daily News Classifieds. Content of Site All postings, text, images, photos, video, sound, or other materials ("Content") posted on, transmitted through, or linked to from the East Texas Daily News Classifieds are the sole responsibility of the person who originated such Content. You are responsible for all Content that you post or otherwise make available through the East Texas Daily News Classifieds and this site. Under no circumstances is East Texas Broadcasting, Inc. or its directors, officers, employees or agents responsible for any loss or damage incurred as a result of the posting or use of any Content submitted by a third party. Your Content and Your Conduct By posting, transmitting, or otherwise making any Content available on the East Texas Daily News Classifieds, you warrant that you have the legal right to do so. East Texas Broadcasting, Inc. reserves the right (but not the obligation) in its sole discretion for any reason to edit or remove any classified ad or other Content without prior warning, notice or compensation to you. You agree not to post, transmit, or otherwise make available any Content that * you do not have the legal right to post; * is illegal, obscene, indecent, harmful to minors, defamatory, libelous, invasive of another's privacy, or infringes on another's proprietary rights, including copyright, trademark, trade dress, trade secrets, or patents; * is threatening, abusive, harassing or degrading to any person; * discriminates on the grounds of race, national origin, ethnicity, religion, gender, age, disability, marital status or sexual orientation; * is false, deceptive or misleading or contains misleading subject line, header or routing information designed to disguise the origin of any Content transmitted through the site; * impersonates any person or entity, other than lawful, non-deceptive parodies of public figures; * contains personally identifying information about another person, without that person's consent; * advertises any products or services that are illegal or restricted by sale by applicable law, including prohibited or restricted under Texas law; * contains any computer virus, spyware, adware or any harmful computer code designed to delay, interrupt or affect the performance of any computer system; * contains any link to commercial services; * contains non-local, irrelevant or otherwise inappropriate Content In addition, you agree not to: (1) contact any person who has asked not to be contacted, stalk or harass anyone; (2) collect personal data about other users for commercial or unlawful purposes; (3) use automated tools to collect data or to access the site; (4) repeatedly post the same item or service in multiple classified categories; (5) use the service or site to post or transmit any spam, scam or unsolicited commercial materials. Notification of Claims of Copyright Infringement If you believe that any content of the East Texas Daily News Classifieds site constitutes infringement of any copyright that you own, please notify East Texas Broadcasting, Inc. East Texas Broadcasting, Inc. may remove the infringing material or otherwise invoke the procedures set forth in the Digital Millennium Copyright Act. Grant of Rights By posting, transmitting, or otherwise submitting Content to the East Texas Daily News Classifieds, you represent that you have the right to grant, and do automatically grant, the East Texas Broadcasting, Inc. a world-wide, royal free and non-exclusive license to use, copy, modify, adapt, perform, publicly display and distribute such Content, and create derivative works of such Content, and to grant and authorize sublicenses of such Content. By posting Content to any public area of the East Texas Daily News Classifieds, you automatically grant the East Texas Broadcasting, Inc. all rights necessary to prohibit any other person from any subsequent aggregation, use, copying, modification, adaptation, performance, public display or distribution of such Content on the East Texas Daily News Classifieds. Fair Housing Notice All housing advertised on the East Texas Daily News Classifieds must be made available on an equal opportunity basis. You may not copy, reproduce, modify, distribute, or create derivative works from any Content on the site without the express written consent of the East Texas Daily News Classifieds. You may not reverse engineer, disassemble or decompile any source code available on this site or comprising all or a part of this site. Termination of Service The East Texas Broadcasting, Inc. has the right, at its sole discretion, to terminate or delete your account on the East Texas Daily News Classifieds, block your e-mail or IP address, or otherwise limit or deny your ability to access the site. You agree that East Texas Broadcasting, Inc., its directors, officers, employees and agents will not be liable to you or any other party for any termination or limitations on your access to the site. Disclaimer of Warranties You agree that your use of the East Texas Daily News classifieds is entirely at your own risk. East Texas Broadcasting, Inc. disclaims any warranties that the service, site, or goods or services purchased in response to any advertisement on the site will be free of computer viruses, spyware, adware, or other harmful components. Some jurisdictions limit or do not allow the disclaimer of implied warranties, and in such jurisdiction some of these disclaimers may not apply to you. Limitation of liability By using the East Texas Daily News classifieds and accessing this site, you agreed that under no circumstances shall East Texas Broadcasting, Inc., its subsidiaries, successors, shareholders, directors, officers, employees, or agents be liable for direct, indirect, incidental, consequential, special, statutory, punitive, or exemplary damages (even if East Texas Broadcasting has been advised of the possibility of such damages), or any monetary damages whatsoever, arising or resulting from any aspect of your use of the East Texas Daily News classifieds, whether the damages arise from use or misuse of the East Texas Daily News classifieds, from inability to use the service, or the interruption, suspension, modification, alteration, or termination of the service. You accept all responsibility for, and hereby agree to indemnify and hold harmless the Indemnified Parties from and against any claim or demand based on the actions of any person using your computer, user ID or password. Jurisdiction, Venue and Choice of Law These Terms of Use shall be governed by, construed and enforced in accordance with Texas law, except for its choice of law rules, as Texas law applied to agreements entered into and to be performed entirely in Texas. Any action you or a third party may bring to enforce these Terms of Use, or in connection with any matters related to the East Texas Daily News Classifieds shall be brought and maintained only in a court of appropriate jurisdiction in Mount Pleasant, Titus County, Texas, and you expressly agree to be subject to the jurisdiction of such courts. Entire Agreement These Terms of Use constitute the entire agreement between you and the East Texas Daily News with regard to any use of the East Texas Daily News Classifieds, superseding any prior agreement or understanding, whether written or oral, between you and the East Texas Daily News. You may also be subject to additional terms and conductions that may apply when you use affiliate services, third-party content or third-party software, or visit another site linked to by this site. Severance If any term of these Terms of Service is found by a court of competent jurisdiction to be for any reason unlawful, invalid, void, or unenforceable, then such provision shall be deemed severed from these Terms of Service, and shall not affect the validity and enforceability of any remaining provisions, and the parties agree that the court should give effect to the parties' intentions as reflected in such remaining provisions. Waiver The failure of the East Texas Daily News to enforce any right or provision in these Terms of Service shall not constitute a waiver of such right or provision, nor constitute a waiver of any other right or provision in these Terms of Service, unless such waiver is expressly acknowledged and agreed by the East Texas Daily News in writing.
